In the United States, open container laws are in effect in most states. These laws prohibit the possession or drinking from any alcoholic beverage while driving. These are state laws and therefore are different from one state to the next. Fines may be as much as $200 for a first time offense. Some will face jail time, up to 30 days for a first time offense. In addition, for many states, it is a requirement to attend alcoholic counseling courses. Multiple offenses may lead to a requirement to have a breath-analyzing device placed on your vehicle.
